As markets improve, buying trends are also changing. We see more and more people exchanging urban life for rural life. But these trades come with problems that are usually unique for large rural plots. Where urban development often takes the form of small land subdivisions, rural land tends to be larger. They also tend to be less accessible and many rural lands lack urban services such as water supply and sanitation, which means well drilling and septic system. It also means access problems. The directive is that the property is so unique and valuable that an owner should not be excluded from access by other features. The most common type of association used in New Hampshire for private road maintenance situations is a non-profit corporation founded under RSA 292.

Although these entities are businesses, the word “association” is often used in the title. The company (association) could be created to indicate that any owner of land automatically becomes a member of the company. (RSA 292 uses the term “member” instead of “shareholder”) A simple statute would be adopted to deal with things like votes, assemblies and collections. Delinqued homeowners can have the biggest headaches when maintaining private roads. A person may disagree with the work or quality to be performed and express that disagreement by refusing to contribute to the costs. . . .
