The directive is that the property is so unique and valuable that an owner should not be excluded from access by other features. The most common type of association used in New Hampshire for private road maintenance situations is a non-profit corporation founded under RSA 292.
Although these entities are businesses, the word “association” is often used in the title. The company (association) could be created to indicate that any owner of land automatically becomes a member of the company. (RSA 292 uses the term “member” instead of “shareholder”) A simple statute would be adopted to deal with things like votes, assemblies and collections. Delinqued homeowners can have the biggest headaches when maintaining private roads.
